Deck Design Services Terms and Conditions

1. Definitions

– “Service” refers to the creation of custom deck plans.
– “Designer” refers to G Squared Design Build.
– “Client” refers to any person who requests the Service.

2. Use of Service

– The Client agrees to provide accurate and complete information for the deck design.
– The Designer reserves the right to reject any project that does not comply with safety standards or local regulations.

3. Intellectual Property

– Plans and designs created by the Designer are the property of the Client, but the Designer retains copyright.
– The Client may not reproduce, distribute, or modify the plans without the Designer’s explicit authorization.

4. Limitation of Liability

– The Designer is not responsible for damages or losses resulting from the construction or use of the deck.
– The Client agrees to follow local regulations and obtain necessary permits before building the deck.

5. Disclaimer of Warranties

– The Service is provided “as is” and “as available”.
– The Designer does not guarantee the accuracy or completeness of the plans.
– Plans provided do not include seals or signatures of engineers, architects, or other professionals.

6. Payment and Cancellation

– The Client agrees to make a one-time payment for the Service.
– Payment can be made through: Zelle, Debit Card ,Credit Card (with a 4% surcharge), Check, or Cash.
– The Client may cancel the Service without charge before making payment.
– Once payment is made, the project will be considered started and no refunds will be given.

7. Project Delivery

– Plans will be created based on information provided by the Client.
– The Designer will strive to ensure accuracy and quality of plans but is not responsible for errors or inconsistencies due to incorrect or incomplete information.
– The estimated project delivery time is defined below these terms and conditions.
– Delivery time begins on the date payment is received.
– Delivery method: The final plans will be delivered digitally via email or downloadable link.
– Note: Physical plans will not be furnished. All deliveries will be in digital format (PDF or similar).

8. Service Request Process

– To initiate the service request process, the Client must complete the provided survey.
– The Client agrees to provide accurate and complete information in the survey and any additional communication.
– A company staff member will contact the Client via email or phone to provide the final plan price, define payment method, and ask additional questions if necessary.

9. Privacy Policy

– The Designer protects Client personal information according to applicable data protection laws.
– The Client agrees that the Designer may use their information for Service purposes.

10. Disclaimer of Legal Liability

– The Client hereby releases and holds harmless the Designer, its officers, directors, employees, and agents from any and all claims, demands, or causes of action arising from or related to the Service.
– The Client agrees to indemnify and hold harmless the Designer against any and all losses, damages, or expenses (including attorney’s fees) incurred in connection with any claim, demand, or action arising from or related to the Service.

11. Governing Law and Jurisdiction

– These Terms and Conditions are governed by the laws of the State of Maryland, United States.
– Any disputes will be resolved in Maryland courts.

12. Acceptance

– By requesting the Service, the Client accepts these Terms and Conditions.
